Terms & Conditions
Definitions
In these terms and conditions:
- "The Contractor" means the roofing and construction company providing the services
- "The Customer" means the person, firm or company placing the order for services
- "The Contract" means the agreement between the Contractor and Customer for the provision of services
Basis of Contract
- All quotations and contracts are subject to these terms and conditions
- Variations or additions to a contract must be agreed in writing by both parties
- The Contractor reserves the right to refuse any contract or order
Payment Terms
- Payment is due in full 7 days after the invoice date, unless otherwise agreed
- The Contractor reserves the right to require a 50% deposit before starting work
- Prices quoted are net and non-negotiable
- Interest will be charged on overdue payments at 8% above HSBC's base rate
- The Contractor reserves the right to suspend work if payments are overdue
- The Customer is responsible for all costs incurred in recovering overdue payments
Customer Responsibilities
- The Customer is responsible for ensuring the roof structure is sufficient for the work
- The Customer must obtain all necessary permissions, approvals and consents
- The Customer shall provide the Contractor with access to the site as required
Limitation of Liability
- The Contractor's liability is limited to the contract price
- The Contractor is not liable for delays or damages caused by circumstances beyond their control
- The Contractor is not responsible for damage to existing ceilings, walls, gutters or building fabric
- The Contractor will not be liable for any consequential loss or damage
Guarantees
- The length of the guarantee is stated in the quotation
- The guarantee does not take effect until full payment is received
- The Contractor will repair any workmanship defects reported within the guarantee period
- The guarantee is subject to exclusions such as subsidence, vandalism, faulty design, and weather damage
- The guarantee is void if the Customer instructs others to work on the roof
Cancellation
- The Customer may cancel within 14 days if the work will not start for 21 days
- The Customer will be liable for costs incurred up to cancellation
- The Contractor reserves the right to cancel a contract at any time
Disputes
- Any disputes may be referred to adjudication under the Housing Grants Act
- The contract will be governed by the laws of England and Wales
